The High Court in Malaysia allowed an application to change the name on an identity card under Regulation 14 of the National Registration Regulations 1990. Before filing a formal application to the High Court, the applicant had initially requested the relevant department to change his name. This request was denied on the grounds that his surname must match his biological father's surname according to Section 13 of the Births and Deaths Registration Act 1957 ("Act"). Displeased with this rejection, the applicant proceeded with the application to the High Court.

Upon reviewing the application, including the applicant's reasons and the relevant laws, the High Court allowed the application. The Court found that the department's rejection was incorrect because the change involved only the name on the identity card, not the birth certificate. Thus, Section 13 of the Act did not apply. Furthermore, the High Court highlighted that name changes can be processed under Regulation 14 of the National Registration Regulations 1990 (pursuant to Section 6 of the National Registration Act 1959). As long as the applicant had officially renounced his biological father’s surname and fulfilled the procedural requirements, the application for the name change was valid.
